A large part of her practice involves the representation of persons charged with alcohol related driving offenses in Boulder courts and at the administrative driver’s license hearings. Kristan is proud of her successes in both forums, including attaining non-alcohol offers and winning her clients’ driver’s license hearings. Kristan recently successfully defended the prosecution’s appeal of her win of a motions hearing in a DUI case. A motions hearing is the defense lawyers means to challenge the constitutionality of a stop or arrest in a criminal case. A win at the motions hearing means that the prosecution is deprived of presenting some often critical evidence and will often make a better offer due to the weakness of their case without the evidence.
